This Volunteer Participation Waiver & Disclaimer applies to in-person and virtual volunteer activities organized or facilitated by The Mom Crew Foundation. Please read it carefully before registering or participating.
1. Voluntary Participation
I understand that my participation is voluntary. Unless The Mom Crew Foundation agrees otherwise in writing, I am serving as a volunteer, will not be paid for my services, and am not entitled to employee wages or benefits.
2. Assumption of Inherent Risks
I understand that volunteer activities may involve risks that vary by activity, including physical exertion, lifting, travel, weather, use of equipment, slips or falls, interaction with members of the public, and other foreseeable or unforeseeable hazards. I voluntarily assume the inherent risks of the activities in which I choose to participate, to the extent permitted by law.
3. RELEASE OF CLAIMS, INCLUDING NEGLIGENCE
TO THE FULLEST EXTENT PERMITTED BY TEXAS LAW, I RELEASE AND HOLD HARMLESS THE MOM CREW FOUNDATION, ITS DIRECTORS, OFFICERS, EMPLOYEES, VOLUNTEERS, AGENTS, AND EVENT PARTNERS FROM CLAIMS FOR PERSONAL INJURY, DEATH, OR PROPERTY DAMAGE ARISING FROM MY VOLUNTEER PARTICIPATION, INCLUDING CLAIMS CAUSED BY THE ORDINARY NEGLIGENCE OF A RELEASED PARTY. THIS RELEASE DOES NOT APPLY TO CLAIMS THAT CANNOT LAWFULLY BE RELEASED.
I understand that this section is intended to be a conspicuous release of claims, including claims based on a released party’s ordinary negligence, subject to applicable law.
4. Safety and Medical Care
I agree to follow reasonable safety instructions and to inform an event coordinator if I cannot safely perform an assigned task. In an emergency, I authorize The Mom Crew Foundation or event personnel to contact emergency services when reasonably necessary. I understand that The Mom Crew Foundation does not provide health insurance for volunteers and that I am responsible for my own medical expenses except to the extent otherwise required by law.
5. Transportation
Unless The Mom Crew Foundation expressly agrees otherwise in writing, volunteers are responsible for arranging and safely completing their own transportation to and from volunteer activities. Participation during travel is at the volunteer’s own risk, subject to applicable law.
6. Photo, Video, and Audio
The Mom Crew Foundation may photograph or record volunteer events for mission-related communications, education, fundraising, and promotion. If I do not want my identifiable image or voice used, I may notify the event coordinator or email hello@momcrewdfw.org. The Foundation will make reasonable efforts to honor prospective opt-out requests. A separate release may be requested for featured, testimonial, or commercial-style uses.
7. Code of Conduct
Treat participants, volunteers, staff, and community members with respect and dignity.
Follow lawful instructions, event rules, and safety procedures.
Do not engage in harassment, discrimination, violence, unsafe conduct, or unlawful activity.
Protect confidential or sensitive information learned through volunteer service.
Promptly report safety concerns, injuries, or serious misconduct to an event coordinator.
8. Minors
Volunteers under 18 may participate only under the conditions established for the applicable activity. Parent or legal-guardian consent may be required, and some activities may require a parent or legal guardian to be present. The Mom Crew Foundation may restrict particular volunteer roles by age for safety, legal, or program reasons.
9. Screening and Eligibility
Certain volunteer roles may require additional eligibility checks, training, background screening, confidentiality commitments, or role-specific waivers, particularly when a role involves vulnerable individuals, driving, money, confidential information, or higher-risk activities.
10. Governing Law and Severability
This agreement is governed by Texas law, without regard to conflict-of-law principles. If any provision is held unenforceable, the remaining provisions will continue to the fullest extent permitted by law. Any venue provision or dispute process will be subject to applicable law and the specific circumstances of the dispute.
11. Acknowledgment
By electronically accepting this agreement, submitting a volunteer registration that clearly incorporates it, or signing it, I acknowledge that I have had an opportunity to read and understand this agreement and agree to its terms. The Mom Crew Foundation should present this waiver before participation and retain a record of acceptance.
